Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the ContinuationTrades website, dashboard, and related services (the “Service”) operated by ContinuationTrades (“we”, “us”, “our”). By creating an account, subscribing, or otherwise using the Service, you agree to be bound by these Terms.

1. Eligibility

You must be at least 18 years old and legally capable of entering into a binding agreement in your jurisdiction. The Service is offered for informational and analytical purposes only and is not directed at anyone under 18.

2. Accounts

  • You are responsible for maintaining the confidentiality of your account credentials.
  • You are responsible for all activity that occurs under your account.
  • You agree to provide accurate, current, and complete information at sign-up.
  • We may suspend or terminate accounts that violate these Terms, with or without notice.

3. Subscription and Billing

  • Paid plans are billed in advance on a recurring basis (monthly or annually) through our payments processor, Stripe. Pricing displayed at checkout is the price you will be charged, plus any applicable taxes.
  • Subscriptions automatically renew at the end of each billing period unless cancelled before the renewal date through your account settings.
  • You may cancel at any time. Cancellation takes effect at the end of the current billing period; you retain access until that date.
  • Except where required by law, fees paid are non-refundable. We may, at our sole discretion, issue refunds or credits on a case-by-case basis.
  • Failed payments may result in suspension of access until payment is resolved.

4. Acceptable Use

You agree not to:

  • Resell, redistribute, or sublicense the Service or any of its data without our written consent.
  • Scrape, mirror, or otherwise extract bulk data from the Service.
  • Reverse-engineer, decompile, or attempt to derive the source code of the Service.
  • Use the Service to violate any law or the rights of any third party.
  • Circumvent any rate limits, security measures, or access restrictions.
  • Share account credentials with any other person.

5. Market Data and Third-Party Sources

The Service relies on market data provided by third-party vendors (including Polygon.io). We do not guarantee the accuracy, completeness, timeliness, or availability of any data delivered through the Service. Data may be delayed, contain errors, or be unavailable at times due to upstream issues outside our control.

6. No Financial Advice

ContinuationTrades is an informational tool. We are not a licensed broker-dealer, investment adviser, or financial planner. Nothing in the Service constitutes investment advice, a recommendation to buy or sell any security, or a solicitation to enter into any transaction. See our Risk Disclaimer for further detail.

7. Intellectual Property

All software, design, content, and trademarks of the Service are owned by us or our licensors and are protected by copyright and other intellectual-property laws. We grant you a limited, non-exclusive, non-transferable license to use the Service for your personal, non-commercial purposes during the term of your subscription.

8. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY DATA WILL BE ACCURATE OR COMPLETE.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, OR DATA, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY UNDER THESE TERMS WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

10. Indemnification

You agree to indemnify, defend, and hold harmless ContinuationTrades and its affiliates from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party right.

11. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, for any reason — including but not limited to a violation of these Terms. You may terminate your account at any time by cancelling your subscription and requesting account deletion through your account settings.

12. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated by email and/or an in-app notice. Continued use of the Service after the effective date of the updated Terms constitutes acceptance of the changes.

13. Governing Law

These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-law provisions. Any disputes arising from these Terms will be resolved in the state or federal courts located in Delaware.
